FDA Scandals

Dental Amalgam Scandals A known neurotoxin such as mercury, with a vast history of scientific studies indicating harm at low levels of exposure, could not remain on the market as a medical implant for over 30+ years without a plethora of scandals to accompany it. Many of the articles in this section are based on researchers first hand experience with various health agencies of the federal government and Freedom of Information (FOIA) documents obtained by consumer advocacy groups.
The American Dental Association (ADA) The history of The American Dental Association (ADA) is inextrictably tied to the promotion of dental amalgam and its alleged safety. The ADA has spent up to 2 million dollars a year lobbying on behalf of its interests. Through its affiliates, the ADA dictates dental school cirriculum in the USA. In addition members of the ADA have lead The National Institute of Dental and Craniofacial Research and The FDA's Centers for Devices and Radiological Health.
The Agency for Toxic Substances and Disease Registry (ATSDR) The Agency for Toxic Substances and Disease Registry continually fails in its mission to serve the public through responsive public health actions to protect people from environmental hazards and toxic exposures. ATSDR has yet to educate communities, partners, and policy makers about the health risks associated with dental mercury fillings. ATSDR authored the 1999 "toxicological profile on mercury".
The Environmental Protection Agency (EPA) The mission of the EPA is to protect human health and to safeguard the natural environment — air, water, and land — upon which life depends. The EPA's mercury amalgam waste regulations have been overtly influenced by the American Dental Association. At 24 tons, dentists are some of the largest contributors of mercury into our environment. In addition the EPA fails to address direct to air releases from dental offices and dental mercury emissions from crematories.
The European Union - EU - SCENIHR The European Union's Scientific Committee on Emerging and Newly Identified Health Risks (SCENIHR) provides opinions on emerging or newly-identified health and environmental risks and on broad, complex or multidisciplinary issues requiring a comprehensive assessment of risks to consumer safety or public health and related issues not covered by other community risk assessment bodies. SCENIHR released a blatantly misleading report, promoting the safety of mercury dental fillings.
The Food and Drug Administration (FDA) For over 34 years the FDA avoided properly classifying dental mercury amalgam fillings (a medical implant). In 2009 the FDA lost a lawsuit and were mandated by a court order to classify amalgam fillings. During the past 33 years the FDA has consistently acted in a manner opposite their mission statement in regards to dental amalgam. "FDA is responsible for protecting the public health by assuring the safety, efficacy and security of... "medical devices".
FDI World Dental Federation FDI World Dental Federation is a membership organisation composed of more than 200 member National Dental Associations and specialist groups, altogether representing more than one million dentists worldwide. The organisation is governed by a Council of delegates from member associations that are elected by a General Assembly during the FDI Annual World Dental Congress (AWDC).
The National Institute of Dental and Craniofacial Research (NIDCR) The mission of the National Institute of Dental and Craniofacial Research (NIDCR) is to improve oral, dental and craniofacial health through research, research training, and the dissemination of health information. NIDCR is the Nation’s leading funder of oral, dental, and craniofacial research. 75% of NIDCR’s budget goes to grantees at universities, dental schools, and medical schools across the country
The National Institutes of Health (NIH) The NIH, a part of the U.S. Department of Health and Human Services, is the nation’s medical research agency. NIH is the largest source of funding for medical research in the world. The NIH killed funding to the researcher who was able to show that mercury reproduced three of the biochemical hallmarks of Alzheimer's Disease.
The Office of Management and Budget (OMB) The OMB reviews agency budgets, management, legislative, regulatory, financial, procurement, and other proposals; assures that all such proposals are consistent with relevant statutes and Presidential objectives; provides both short-range and long-range analysis and advice to government officials on a variety of subjects; and develops Government-wide policies.
The Occupational Safety & Health Administration (OSHA) OSHA's role is to assure safe and healthful working conditions for workers by authorizing enforcement of the standards developed under the Act. But, despite knowledge of mercury's widespread use in dentistry and elevated levels of mercury in dental offices during placement, polishing and removal OSHA refuses to enforce current regulations that would protect both staff and patients from uneccessary mercury exposure.
Study Scandals There have been many studies claiming amalgam safety which have downplayed mercury exposure and adverse health effects from that exposrue. Unfortunately, only those studies showing safety get huge coverage in the press without ever mentioning any of those studys inherent flaws or conflicts of interests. In this section we offer a critical look at those studies.
The United Nations - UN The United Nations Environment Programme (UNEP) coordinates United Nations environmental activities at the global and regional level. Its mandate is to coordinate the development of environmental policy consensus by keeping the global environment under review and bringing emerging issues to the attention of governments and the international community for action.
The World Health Organization - WHO WHO is the directing and coordinating authority for health within the United Nations system. It is responsible for providing leadership on global health matters, shaping the health research agenda, setting norms and standards, articulating evidence-based policy options, providing technical support to countries and monitoring and assessing health trends. The dental division within The WHO has continually released unsanctioned papers promoting the safety of mercury fillings.

2008 FDA ignores science & deflects responsibility

FDAIn 2008 a group of widely published mercury researchers took two dozen new studies indicating harm from mercury vapor emitted from dental amalgam fillings to FDA's associate commissioner of science, Norris Alderson. While Alderson told them he agreed with them, he stated he couldn't do anything about it unless they (the researchers) got the American Dental Association to agree with them.

Boyd Haley PhD
Discusses the outcome of a meeting with the FDA
after presenting evidence of harm from mercury fillings

AFFIDAVIT OF BOYD E. HALEY, PhD

FDA AGAIN REFUSES TO ACT TO CLASSIFY AMALGAM

I, Boyd Haley, swear that the following is true and based upon my personal knowledge.

1. I have a Ph.D. from Washington State University and did three years of post-doctoral work at the Yale University Medical School. I am a full professor of Chemistry and Biochemistry at the University of Kentucky and was chairman of the Department of Chemistry for eight years.

2. Throughout my career I have studied the effects of numerous compounds on the changes of the activity of enzymes, proteins and cellular function proteins and the relationship of these changes to disease states. In the past 14 years I have concentrated my research on the effects of mercury toxicity on human health. Specifically, I have researched and evaluated the contributions of dental amalgam, biologics and vaccines on the human body burden of mercury and organic-mercury compounds and the potential effects of these compounds on specific enzymes and cells. I have published approximately 120 papers, and own five patents. Attached, as Exhibit A, are a one-page biography and an abbreviated copy of my Curriculum Vitae. The full CV is approximately twenty five pages and is attached as Exhibit B.

3. My professional research and literature reviews have convinced me that mercury, a virulent neurotoxin, should never be implanted in the mouth or anywhere else in the human body. See my affidavit of April 22, 2008, filed with the Motion for Preliminary Injunction in the above-captioned case, which sets out the scientific basis for this opinion.

4. I am not paid for this statement. I have never charged any mercury-free dentist or any consumer organization for more than travel expenses to serve as an expert witness on the issue of mercury fillings. I have spoken to dozens of scientific, dental, and consumer organizations about mercury fillings, generally for no compensation, although on rare occasions I received an honorarium. I have no financial affiliation with any organization seeking a ban on the use of mercury amalgam.

5. I am an (unpaid) member of the Scientific Advisory Committee of the International Academy of Oral Medicine and Toxicology, www.iaomt.org, a dentist-based organization that shares my views that mercury amalgam should be banned. In that capacity, I have held two meetings in 2007-08 with FDA's top scientist, Associate Commissioner for Science, Norris Alderson.

6. At the first of those meetings, in the summer of 2007, Alderson indicated FDA was ready to move quickly to address toxicity issues regarding mercury amalgam, and would likely order limits on the use of amalgam for vulnerable subpopulations like pregnant women and children. At the second meeting, held March 28, 2008, the entire tone had changed considerably; Alderson repeatedly emphasized that FDA was immobilized on mercury amalgam and unlikely to do anything. That latter meeting was also attended by Professor Vasken Aposhian of the University of Arizona; Professor Louis Chang, formerly a professor at the University of Arkansas and now head of the government of Taiwan's equivalent of the FDA; dentist Richard Fischer of Annandale Virginia; and Dr. Michael Fleming, member of FDA's Dental Products Scientific Advisory Committee --- all requesting Alderson to move forward and classify mercury amalgam in a way to protect the public generally, or at least vulnerable subpopulations (fertile women, pregnant women, children, those with compromised kidney function and those with genetic susceptibilities), from its virulent toxicity.

7. At the March 28, 2008, meeting, the five of us presented Alderson with a substantial body of evidence to support our position that the FDA should place limits on the use of mercury amalgam dental fillings. This included all the items listed on, and attached to this affidavit, marked as Exhibit C (International Academy of Oral Medicine and Toxicology - Submissions to the FDA Panel September 6-7, 2006, Review of the Safety and Effectiveness of Dental Amalgam) and an 11 slide PowerPoint presentation prepared and presented by me, which is attached, with an explanatory cover sheet, as Exhibit D. We explained the scientific evidence supporting our opinion that mercury amalgam dental fillings present an unacceptable health risk to the human body.

8. At that March 28 meeting, when the scientists discussed the toxicity of mercury amalgam, Alderson replied something to the effect, "You are preaching to the choir." I understood this comment to mean that Alderson agreed with me and other meeting participants that mercury amalgam dental fillings were an unacceptable source of mercury exposure to the human body and capable of causing health harm.

9. While agreeing with us on the science, Alderson (FDA's top scientist) said the FDA was not going to do anything, repeatedly refusing to say why.

10. Alderson claimed that FDA cannot take actions that might result in the restriction of use of mercury amalgam dental fillings for children, pregnant mothers or women of childbearing age. We were shocked, because it was the opposite of what he had said last year, when he was indicating FDA had intentions to do just that. I asked him why FDA could not restrict amalgam use, and he said he couldn't or wouldn't say why.

11. Alderson said, if the scientists wanted to get FDA to act on mercury fillings, they needed to enlist support from the American Dental Association, or would need to get another law passed. We left the meeting with the firm understanding that the FDA was not going to do anything to change the current status of dental amalgams as an unclassified dental device.

12. Later that day, all of us (but not Alderson) met with several employees of the Dental Devices Branch, the agency in charge of classifying mercury amalgam. I was struck by the youth and inexperience of all but one of the members (the dentist was older) and the total lack of educational background of any of them to evaluate the toxicity of mercury, mercury amalgam, or any other dental material.

13. The evidence against the use of mercury amalgam dental fillings in the human mouth continues to mount every week. I have attached as Exhibit E, a new peer-reviewed article published in the Journal of Exposure Science and Environmental Epidemiology (2008), which analyzed the relationship between maternal dental amalgam fillings and exposure of the developing fetus to mercury. The investigators found a strong positive correlation between maternal and cord blood mercury levels; and, the cord blood mercury levels were significantly associated with the number of maternal amalgam fillings. The investigators concluded that "dental amalgam fillings in girls and women of reproductive age should be used with caution, to avoid increased prenatal mercury exposure."

14. I make this Affidavit in support of Plaintiffs' Motion for a Preliminary Injunction in the above-captioned case.

mercury-exposure-avatarFor years I've read news stories about dental mercury amalgam fillings that failed to ask vital follow up questions for one to form a better understanding of the true risks involved with exposure to mercury fillings. Rarely was a toxicologist, neurologist or bio-chemist interviewed. Instead, the stories would always give dentists such prominence when promoting the safety of a substance of which they knew nothing about, all while never acknowleding the much lower levels of mercury at which our government has removed other products from the market. So now I'm doing what I can to help raise awareness of the many dangerous aspects of dental mercury fillings.

In item 13 of Dr Haley's affidavit, he mentions a point that responsible mothers-to-be should be made aware of - "... the relationship between maternal dental amalgam fillings and exposure of the developing fetus to mercury. The investigators found a strong positive correlation between maternal and cord blood mercury levels; and, the cord blood mercury levels were significantly associated with the number of maternal amalgam fillings.

Babies born to mothers who are pickled in fluoride are sprouting their first teeth with fluorosis already built in, which means that the baby is poisoned with fluoride before it's even born. The same would have to apply to mercury poisoning; if a mother's body is host to a steady flow of mercury from her amalgams, then some of it is bound to end up in the tissues of the fetus. And then, further down the track, the mother will take the baby to a doctor who can't understand why the baby is not well ... but one thing we know for sure is that this doctor will certainly find something to jab the baby with, which in turn means what? More mercury?
